TracoIt Travel Partner Terms of Service

For Sellers, Travel Agents & Tour Operators

These terms constitute a binding agreement between TracoIt ("The Platform") and You ("The Travel Partner" or "Agency"). By listing your services on TracoIt, you agree to the following conditions.
  • Platform Relationship

    Marketplace Role: You acknowledge that TracoIt acts solely as an e-commerce marketplace to connect you with potential customers.

  • Operational Responsibility & Liability
    • Full Liability: You, the Travel Partner, assume 100% responsibility for the organization, execution, and safety of all trips listed under your profile.
    • Safety & Risk: You are solely liable for the safety, security, and well-being of the customers during the trip. TracoIt shall not be held liable for any accidents, injuries, losses, or damages occurring during the travel period.
    • Indemnification: You agree to indemnify and hold TracoIt harmless against any claims, lawsuits, or demands arising from your services or the actions of your staff.
  • Service Obligations
    • Itinerary Fulfillment: You are legally obligated to provide every service, amenity, accommodation, and activity exactly as described in the itinerary listed on the platform.
    • Mandatory Contact Details: Your listing must include:
      • A valid support Phone Number.
      • A functional WhatsApp number for customer queries.
      • A downloadable PDF detailing the full trip itinerary.
  • Media & Content Rights
    • Ownership Warranty: You warrant that all photos, videos, and media uploaded to your listings are owned by you or that you possess the necessary commercial licenses to use them.
    • Copyright Liability: TracoIt accepts no responsibility for copyright violations. Any legal action resulting from the unauthorized use of media is the sole responsibility of the Travel Partner.
  • Cancellation & Refunds
    • Policy Definition: You are responsible for defining and clearly displaying your cancellation policy on the platform.
    • Refund Processing: You are solely responsible for processing and issuing refunds to customers in accordance with your stated policy. TracoIt is not responsible for funding or facilitating refunds for your cancellations.
  • Data Security
    • Your Data: TracoIt commits to keeping your business data and seller information secure and private.
    • Customer Data: You agree to use customer data (names, numbers, etc.) provided via the platform strictly for the purpose of fulfilling the travel service and in compliance with data privacy laws.
  • Updates to Terms

    TracoIt reserves the right to modify these terms at any time. You will be notified of major updates, and continued use of the platform implies acceptance of the new terms.

  • Listing Visibility & Search Ranking
    • Search Placement: The positioning and visibility of your trips in customer search results are determined automatically by TracoIt's internal systems.
    • Ranking Factors: The hierarchy of listings is based on a proprietary algorithm that considers multiple factors, including but not limited to:
      • Customer Reviews
      • Aggregate Ratings
      • Pricing Competitiveness
    • No Guarantee: TracoIt does not guarantee a specific position (e.g., "top of the page") for any listing. High-quality service and positive reviews are the best way to improve your ranking.
